18 U.S.C. §2257 Statement
Last updated: October 8, 2026
No real persons depicted
All visual depictions on Swoonly are produced entirely by generative artificial-intelligence models. No real person is depicted in any image, video, or voice recording generated through the Service.
Record-keeping exemption
Because every visual depiction on the Service is wholly computer-generated and does not depict an actual human being, Swoonly is not subject to the record-keeping and labeling requirements of 18 U.S.C. §§2257 or 2257A, which by their terms apply to visual depictions of actual human beings engaged in sexually explicit conduct.
This exemption is also recognized by the Free Speech Coalition's industry guidance for AI-generated adult content.
Absolute prohibitions regardless of medium
Independent of any §2257 exemption, Swoonly absolutely prohibits any sexual depiction of minors, in any medium — real, drawn, animated, or computer-generated. This prohibition is enforced by our automated safety systems, is a term of service that cannot be waived (Terms of Service §4), and any violation will result in immediate account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) under 18 U.S.C. §2258A or the appropriate authority in the user's jurisdiction.
Minimum age for users
All users of the Service must be at least 18 years of age. Age is verified at account creation and may be re-verified during the account lifecycle in connection with payment and compliance requirements.
Custodian of records (reference)
Although Swoonly is not required to designate a §2257 custodian for the reason stated above, the following party is available as a point of contact for questions regarding the generative nature of our content:
