Copyright / DMCA Policy

Last updated: October 8, 2026

1. Our policy

Swoonly respects the intellectual property rights of others and expects users to do the same. We respond to clear, complete notices of alleged copyright infringement under the United States Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. §512, and comparable Canadian notice provisions under the Copyright Act.

2. How to send a takedown notice

If you believe content on Swoonly infringes a copyright you own or represent, send a written notice to our Designated Agent that includes all of the following, as required by 17 U.S.C. §512(c)(3):

  • A physical or electronic signature of the owner or an authorized agent.
  • Identification of the copyrighted work you claim has been infringed.
  • The URL or other reasonably sufficient location of the material on Swoonly that you want removed or disabled.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

3. Designated Agent

Notices may be sent to:

DMCA Designated Agent
Craig Kidney (Swoonly)
New Brunswick, Canada
[email protected]

Our registration with the U.S. Copyright Office under 17 U.S.C. §512(c)(2) is in progress; this page will be updated with the registration record once filed.

4. Counter-notice

If content you posted was removed as a result of a DMCA notice and you believe the removal was mistaken, you may file a counter-notice under 17 U.S.C. §512(g)(3) by sending the Designated Agent a written notice that includes all of the following:

  • Your physical or electronic signature.
  • Identification of the material and the location at which it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, mailing address, telephone number, and consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Swoonly may be found).
  • A statement that you will accept service of process from the claimant or their agent.

Submitting a false counter-notice may expose you to legal liability.

5. Repeat-infringer policy

Swoonly maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

6. False claims

Under 17 U.S.C. §512(f), knowingly misrepresenting that content is infringing may expose you to liability for damages. Please do not file a notice unless you are the copyright owner or authorized to act on their behalf.

7. Other intellectual-property claims

For trademark, right of publicity, or other non-copyright claims, please contact [email protected] with the same level of detail as a DMCA notice.
